ARTICLE 1 INTRODUCTION
1.1. Welcome to catacombspass.com (the “Website”). This Website is owned and operated by Underworld Pass, a company registered in the United Arab Emirates, with its registered office in Ajman, UAE (“we”, “us”, “our”).
1.2. These Terms and Conditions (the “Terms”) apply to your access to and use of the Website, and to the purchase of digital experience packages (the “Packages”) related to the Paris Catacombs as offered through the Website.
1.3. By browsing the Website, creating an account (if applicable), or purchasing a Package, you (“you”, “your”, “User”, or “Customer”) agree to be bound by these Terms and our Privacy Policy available at https://catacombspass.com/privacy-policy/. If you do not accept these Terms, you must not use the Website.
1.4. These Terms are governed exclusively by the laws of the United Arab Emirates.
ARTICLE 2 SERVICE DESCRIPTION
2.1. The Website is an online platform through which users may explore and purchase Paris Catacombs experience Packages.
2.2. Each Package typically includes:
- exclusive digital content, including a storyboard and a podcast; and
- concierge, organisational, assistance and support services in connection with the Paris Catacombs experience.
2.3. Where stated in the relevant Package description, Underworld Pass may also arrange an official admission ticket or reserved access slot in connection with the Package, acting strictly as the Customer’s agent and on the Customer’s behalf.
2.4. Any such official admission ticket or reserved access slot is provided solely as a complimentary inclusion within the Package. It is not sold separately, not priced separately, not invoiced separately, and not charged separately to the Customer at any time.
2.5. The Customer acknowledges and agrees that the amount paid on the Website is the price of the Package only, and does not represent, in whole or in part, the purchase price of any admission ticket.
2.6. Underworld Pass does not operate the Paris Catacombs site or any part of the monument. Our role is strictly limited to providing digital content and concierge-related services connected with the Customer’s experience.
2.7. Underworld Pass does not represent that it sells, resells, or transfers any standalone admission ticket in its own name.
2.8. Underworld Pass is an independent concierge and digital content provider. Nothing on the Website shall be interpreted as meaning that Underworld Pass is the official ticket office or the official operator of the Paris Catacombs.
2.9. Independence and Non-Affiliation Disclaimer. Underworld Pass is not affiliated with, endorsed by, sponsored by, or acting as an agent of Paris Musées, the Paris Catacombs, or any official operator or authority responsible for the management of the Paris Catacombs. Any official admission ticket or reserved access slot arranged in connection with a Package is obtained through the official operator’s system strictly on behalf of, and as agent for, the Customer. The contractual relationship for physical access to the Paris Catacombs exists solely between the Customer and the official operator.
2.10. Nature of the Service – Transparency Notice. The Package price reflects exclusively the value of the digital content and the concierge, organisational, assistance and support services provided by Underworld Pass. Where an official admission ticket or reserved access slot is arranged in connection with a Package, it is included on a complimentary basis only and has no standalone sale value vis-à-vis the Customer.
2.11. The purchase made through the Website is therefore a purchase of a Package only, and does not constitute the separate purchase of an individual admission ticket from Underworld Pass.
2.12. Transparency Notice on Official Fraud Warnings. The Customer acknowledges that the official operator of the Paris Catacombs (Paris Musées) publishes warnings on its website relating to fraudulent or unauthorised third-party ticketing websites. The Customer confirms that prior to purchase, they have read these Terms in full and understand that Underworld Pass is an independent concierge and digital content service, not an unofficial ticket reseller, and that any entry document arranged as part of a Package is sourced exclusively through legitimate channels. The Customer confirms that they did not experience any misleading representation as to the nature, affiliation, or official status of Underworld Pass before or during the purchase process.
ARTICLE 3 – CONCIERGE MANDATE AND CUSTOMER’S COMPLIANCE WITH OFFICIAL OPERATOR RULES
3.1. Concierge Mandate. By purchasing a Package that includes the arrangement of an official admission ticket or reserved access slot, the Customer expressly and irrevocably designates Underworld Pass as their personal agent and mandatory (wakil) under UAE Federal Law No. 5 of 1985 on Civil Transactions (Articles 924-974), solely for the purpose of:
- acting strictly as the Customer’s agent in submitting a reservation or booking request to the official operator in the Customer’s name and on the Customer’s behalf;
- selecting among available time slots as close as reasonably possible to the Customer’s indicated preferences, where the exact requested slot is unavailable;
- accepting, on the Customer’s behalf, any booking conditions imposed by the official operator that are necessary to finalise the reservation; and
- communicating to the official operator only such personal data as is strictly necessary for the purpose of arranging the reservation.
3.2. The Customer acknowledges that Underworld Pass acts solely as their agent in arranging access, and that the resulting contract for physical admission to the Paris Catacombs is formed exclusively between the Customer and the official operator, and is subject to the official operator’s own terms, conditions, and visitor rules.
3.3. Customer’s Obligation to Comply with Official Operator Terms. By purchasing a Package, the Customer acknowledges that access to the Paris Catacombs is governed exclusively by the terms, conditions, visitor rules, and regulations of the official operator (currently Paris Musées). The Customer agrees to:
- read, accept, and comply in full with the official operator’s terms and conditions of entry, available at https://www.catacombes.paris.fr and https://www.billetterie-parismusees.paris.fr;
- comply with all on-site rules, safety requirements, security measures, dress code, prohibited items policies, and behavioural requirements imposed by the official operator;
- present valid and compliant documentation at the point of entry as required by the official operator; and
- ensure that all participants included in the booking are aware of and comply with the official operator’s conditions.
3.4. Administrative Reference on Entry Documents. All reservations arranged on your behalf are made in your name as the visiting party. In the rare event that an entry document displays an administrative reference linked to our concierge account, our team will provide you with full written confirmation of your reservation details to present at the venue if needed. We are here to support you throughout your visit.
3.5. Access to the Paris Catacombs is managed exclusively by the official operator on-site. While we take all necessary steps to ensure your reservation is correctly processed, on-site access decisions remain at the discretion of the venue’s staff. Should any issue arise on the day of your visit, please contact our team immediately we will do everything within our power to assist you.
3.6. Underworld Pass bears no responsibility for any refusal of entry, removal from the site, or restriction of access resulting from the Customer’s or any participant’s failure to comply with the official operator’s terms, conditions, or visitor rules. No refund shall be due from Underworld Pass in such circumstances.
3.7. The official operator’s terms and conditions may be updated from time to time. It is the Customer’s sole responsibility to consult the current version of the official operator’s terms prior to the visit.
3.8. Customer Indemnification for Third-Party Claims. Should any third party, including Paris Musées or any authority, bring any claim, action, or proceeding against Underworld Pass arising directly or indirectly from the Customer’s use or misuse of any ticket or access document, the Customer agrees to fully indemnify and hold harmless Underworld Pass from all resulting costs, penalties, fines, legal fees, and damages.
ARTICLE 4 BOOKING PROCESS
4.1. To purchase a Package, you must select the relevant date, time slot, period, or other options displayed on the Website, where applicable.
4.2. You may be required to provide accurate and complete contact, participant, and payment information necessary for the processing of your order and the delivery of your Package.
4.3. By submitting a booking request and completing payment, you are making an offer to purchase the selected Package under these Terms.
4.4. All orders are subject to availability and acceptance by us.
4.5. A booking confirmation (the “Booking Confirmation”) will be sent to the email address you provided once your payment has been successfully processed and your order has been accepted.
4.6. The Booking Confirmation represents acceptance of your order and the formation of a contract between you and Underworld Pass for the purchase of the Package.
4.7. The Booking Confirmation, invoice, receipt, and any payment record issued by Underworld Pass relate exclusively to the Package price and do not constitute a separate sale, separate invoicing, or separate transfer of any admission ticket.
4.8. If applicable, the travel or access documents delivered in connection with the Package (the “Travel Documents”) may include:
- a booking reference and/or QR code;
- the date and time of the scheduled visit; and
- practical instructions relevant to the experience.
ARTICLE 5 PRICING AND PAYMENT
5.1. All Package prices displayed on the Website are listed in USD (United States Dollar), unless otherwise stated.
5.2. Package prices relate exclusively to the Package and to the services and digital content supplied by Underworld Pass, as described on the relevant product page.
5.3. Where an official admission ticket or reserved access slot is arranged in connection with a Package, it is included on a complimentary basis only and is not separately charged, separately invoiced, or sold as a standalone item. No portion of the Package price shall be construed as representing the cost of an admission ticket.
5.4. Unless expressly stated otherwise, displayed prices include applicable taxes and standard booking-related charges.
5.5. Package prices generally include:
- access to the digital content described in the Package, including the storyboard and podcast;
- concierge, organisational, assistance and support services; and
- where applicable, the complimentary arrangement of an official admission ticket or reserved access slot on behalf of the Customer.
5.6. Package prices do not include, unless expressly stated:
- transportation;
- accommodation;
- food and beverages;
- personal expenses; or
- any service not expressly described in the Package.
5.7. Payment must be made in full using one of the payment methods made available on the Website at the time of purchase.
5.8. You confirm that you are authorised to use the chosen payment method and that all payment details submitted are complete and accurate.
5.9. Underworld Pass reserves the right to amend Package prices at any time before your order is accepted. Once a Booking Confirmation has been issued, the price is fixed for that booking, except in the case of manifest error.
ARTICLE 6 CHARGEBACK AND PAYMENT DISPUTE MANAGEMENT
6.1. Mandatory Pre-Dispute Contact. Before initiating any chargeback, payment dispute, card scheme complaint, or bank reversal request, the Customer agrees to notify Underworld Pass in writing at help@underworldpass.com, clearly describing the nature of their complaint. Underworld Pass shall have 5 (five) clear business days from receipt of such written notice to respond and attempt resolution.
6.2. Consequence of Non-Compliance. Initiation of a chargeback without prior written notification to Underworld Pass, or initiation of a chargeback in bad faith (including where the Package has been materially delivered), shall constitute a material breach of these Terms.
6.3. Evidence Submission. In the event of any chargeback or payment dispute, Underworld Pass reserves the right to submit to the relevant payment provider, card scheme, acquiring bank, or competent authority all evidence of service delivery, including but not limited to: order records, email delivery logs with timestamps, IP address and device data, digital content access records, booking fulfilment documentation, and any correspondence with the Customer.
6.4. Recovery of Costs. In the event of an unjustified, fraudulent, or bad-faith chargeback, Underworld Pass reserves the right to recover from the Customer the full Package price, any chargeback processing fees imposed by the payment provider, and any reasonable legal or administrative costs incurred in contesting the dispute.
6.5. Anti-Fraud Verification. To protect users and our business operations, Underworld Pass may carry out reasonable anti-fraud and verification checks, including 3D Secure authentication and payer identity verification. Orders suspected of fraud, abuse, or unauthorised payment use may be refused, suspended, or cancelled.
ARTICLE 7 – BOOKING CONFIRMATION, DIGITAL CONTENT AND TRAVEL DOCUMENTS
7.1. The Booking Confirmation, digital content access details (including access to the storyboard and podcast), and any Travel Documents will be delivered electronically to the email address provided during checkout.
7.2. It is your responsibility to ensure that the email address you provide is valid, accurate, and capable of receiving messages from us.
7.3. Underworld Pass shall not be responsible for non-receipt of confirmations, digital content access details, or Travel Documents resulting from an incorrect email address, full inbox, spam filtering, email server rejection, or any other issue outside our reasonable control.
7.4. You are responsible for reviewing your Booking Confirmation and Travel Documents promptly after receipt and notifying us without undue delay if you identify any obvious error in the information we have provided.
7.5. Delivery of electronic documents shall be deemed completed when the relevant message has been accepted by the recipient’s email server, as evidenced by our electronic delivery records.
7.6. If you do not receive your Booking Confirmation or Travel Documents within a reasonable time after payment, you must contact us promptly at help@underworldpass.com.
ARTICLE 8 VALIDITY, CONDUCT AND RESTRICTIONS
8.1. Each Package and any associated Travel Documents are valid only for the date, time, period, and conditions specified in the Booking Confirmation or Travel Documents, where applicable.
8.2. Bookings are personal and may not be resold, commercially exploited, or used for unlawful or fraudulent purposes.
8.3. You are responsible for complying with any practical instructions, safety notices, arrival requirements, or visitor conditions communicated in relation to the experience, including those imposed by the official operator.
8.4. Access to the Paris Catacombs may involve stairs, narrow passages, low lighting, uneven flooring, and other site-specific conditions. You are responsible for ensuring that the Package and any associated visit are suitable for your personal circumstances and for those of any participant included in your booking.
8.5. Certain areas, routes, timings, or parts of the visitor experience may be altered, restricted, delayed, or unavailable due to maintenance, restoration works, operational constraints, safety requirements, weather, public authority decisions, or other circumstances beyond our reasonable control.
8.6. Underworld Pass does not guarantee any specific route, duration, sequence, or on-site experience unless expressly stated in the Package description.
ARTICLE 9 – REFUNDS, EXCHANGES AND CANCELLATIONS
9.1. Non-Refundable Package – UAE Law. In accordance with UAE Federal Decree-Law No. 15 of 2020 on Consumer Protection and UAE Federal Law No. 1 of 2006 on Electronic Commerce and Transactions, the Customer acknowledges that:
- (a) The Package constitutes a time-specific service to be performed on a confirmed date. Once confirmed, the time-specific service element is non-cancellable and non-refundable.
- (b) The Package includes digital content (storyboard, podcast, digital guide) delivered electronically upon booking confirmation. Once such content has been made available to the Customer, that element of the Package is fully performed and non-refundable.
- (c) By completing payment, the Customer expressly agrees that performance of the Package commences immediately upon issuance of the Booking Confirmation, and acknowledges that the Package is non-refundable thereafter, except as expressly provided in these Terms.
9.2. Where a Package includes the arrangement of an official admission ticket or reserved access slot, such arrangement is provided on a complimentary, best-efforts basis only. The complimentary ticket or access slot has no standalone sale value vis-à-vis the Customer and cannot be refunded, exchanged, credited, or compensated separately from the Package.
9.3. Cancellation or Unavailability Affecting the Experience. If an experience is cancelled, materially disrupted, or becomes unavailable due to closure, operational restrictions, security reasons, strike action, force majeure, scheduled renovation works, or other circumstances beyond our reasonable control, Underworld Pass may, at its option:
- offer a rescheduling solution;
- offer an alternative comparable solution; or
- provide a partial or full refund corresponding to the portion of Package services not yet performed.
9.4. If you cancel your booking, do not attend, arrive late, or fail to use the Package, you will not be entitled to any refund or credit, subject to Article 9.5 below.
9.5. Entry Issues. In the exceptional event that you are unable to access the Paris Catacombs on your booked date due to a reservation-related issue attributable to Underworld Pass, we will work with you to find a suitable solution, which may include rescheduling your visit or issuing a refund of the Package price paid, at our discretion and subject to the circumstances of the case.
9.6. Where access is refused by the official operator due to circumstances outside Underworld Pass’s control – including the operator’s own technical issues, venue closure, capacity restrictions, or visitor conduct – Underworld Pass will assess each case individually and in good faith, and may offer rescheduling, a partial credit, or such other remedy as is reasonable in the circumstances. Our commitment is to ensure you have the best possible experience, and we will always work with you to find a fair resolution.
9.7. Once a booking has been confirmed, changes may not be possible. Any change request is subject to operational feasibility and third-party constraints. Underworld Pass is under no obligation to accept change requests after purchase.
9.8. Where a refund is due, it will be made to the original payment method within a reasonable period, subject to the timelines and procedures of the relevant payment provider or bank.
ARTICLE 10 INTELLECTUAL PROPERTY
10.1. All content on the Website and within the Packages, including text, graphics, logos, branding, images, audio content, podcasts, storyboards, layouts, designs, downloadable materials, and other digital assets, is owned by or licensed to Underworld Pass and is protected by applicable intellectual property laws.
10.2. You may not reproduce, copy, modify, distribute, display, perform, republish, sell, resell, license, stream, share, or otherwise exploit any part of the Website or Package content without our prior written consent.
10.3. Subject to these Terms, you are granted a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the digital content supplied with your Package for your own private, non-commercial use only.
ARTICLE 11 – USER CONDUCT
11.1. You agree to use the Website lawfully and in a manner that does not infringe the rights of any other person or interfere with the operation of the Website.
11.2. You must not misuse the Website by knowingly introducing viruses, malware, trojans, worms, logic bombs, bots, scraping tools, or any other harmful technology.
11.3. You must not use the Website for fraudulent bookings, payment abuse, speculative reservations, bulk abuse, or unauthorised commercial activity.
11.4. You must not impersonate any person, use false details, or submit misleading or inaccurate information in connection with an order.
ARTICLE 12 DISCLAIMERS AND LIMITATION OF LIABILITY
12.1. The Website, the Packages, and all associated content and services are provided on an “as is” and “as available” basis.
12.2. While we use reasonable efforts to keep the Website and Package information accurate and up to date, we do not warrant that the Website will always be uninterrupted, secure, or error-free.
12.3. To the fullest extent permitted by UAE law, Underworld Pass disclaims all warranties, representations, and conditions, whether express or implied, in relation to the Website, the Packages, the digital content, and the concierge services.
12.4. Underworld Pass shall not be liable for any delay, disruption, restriction, closure, refusal of access, interruption, or change affecting an experience where such issue arises from the decisions or actions of the official operator or from circumstances outside our reasonable control.
12.5. Underworld Pass shall not be liable for:
- travel costs, accommodation costs, loss of enjoyment, or loss of opportunity;
- any action, claim, or proceeding initiated by Paris Musées, French authorities, or any French public institution against the Customer or against Underworld Pass arising from the Customer’s use of any ticket or access document;
- any cancellation, invalidation, or refusal of tickets by Paris Musées for any reason;
- indirect, incidental, special, punitive, or consequential loss of any kind.
12.6. Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death, personal injury caused by negligence, or any other liability that cannot lawfully be excluded under UAElaw.
12.7. Subject to Article 12.6, our total aggregate liability arising out of or in connection with any Package, order, Website use, or these Terms shall not exceed the total amount actually paid by the Customer for the relevant Package.
ARTICLE 13 – PRIVACY AND DATA PROTECTION
13.1. Our collection, use, storage, and processing of personal data in connection with the Website and the Packages are described in our Privacy Policy available at https://catacombspass.com/privacy-policy/.
13.2. By using the Website and purchasing a Package, you acknowledge that your personal data may be processed for order management, payment processing, customer support, fraud prevention, digital content delivery, and the organisation of the Package, including its transmission to the official operator strictly as necessary for the purpose of arranging your reservation.
13.3. We process personal data in accordance with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL).
ARTICLE 14 – INDEMNIFICATION
14.1. You agree to indemnify, defend, and hold harmless Underworld Pass, its directors, officers, employees, contractors, agents, service providers, and affiliates from and against any claims, actions, liabilities, losses, damages, costs, and expenses, including reasonable legal fees, arising out of or in connection with:
- your use of the Website;
- your breach of these Terms;
- your misuse of any Package, content, or Travel Documents;
- your failure to comply with the official operator’s terms, conditions, or visitor rules;
- your fraudulent, unlawful, or abusive conduct; or
- your infringement of any third-party rights.
ARTICLE 15 – FORCE MAJEURE
15.1. Underworld Pass shall not be in breach of these Terms, nor liable for any failure or delay in the performance of its obligations, if such failure or delay results from events, circumstances, or causes beyond its reasonable control, including but not limited to: acts of God, pandemic, epidemic, public health emergency, war, terrorism, civil unrest, government order or restriction, administrative decision by any authority, closure of the Paris Catacombs by its official operator, strike or industrial action, or technical failure of third-party systems.
15.2. In such circumstances, the obligations of Underworld Pass shall be suspended for the duration of the force majeure event. Where the event continues for more than 30 days, Underworld Pass may terminate the contract and issue a refund limited to the unperformed portion of the Package, excluding any digital content already delivered.
ARTICLE 16 – GOVERNING LAW
16.1. These Terms and any dispute, claim, or matter arising out of or in connection with them, including any non-contractual dispute or claim, shall be governed by and construed exclusively in accordance with the federal laws of the United Arab Emirates as applied in the Emirate of Ajman, including but not limited to:
- UAE Federal Law No. 5 of 1985 on Civil Transactions (as amended);
- UAE Federal Law No. 18 of 1993 on Commercial Transactions (as amended);
- UAE Federal Decree-Law No. 15 of 2020 on Consumer Protection;
- UAE Federal Law No. 1 of 2006 on Electronic Commerce and Transactions.
16.2. No foreign law, including French law, European Union consumer law, or United States federal or state consumer protection law, shall apply to the interpretation, validity, or enforcement of these Terms.
ARTICLE 17 – DISPUTE RESOLUTION AND MANDATORY ARBITRATION
17.1. Amicable Resolution. The parties shall first attempt to resolve any dispute in good faith. The party wishing to bring a claim must serve written notice to help@underworldpass.com specifying the nature of the dispute, the relevant facts, and the relief sought. Underworld Pass shall have 10 (ten) business days from receipt to respond and attempt resolution.
17.2. Mandatory Binding Arbitration. If the dispute is not resolved amicably within 15 (fifteen) calendar days of the written notice, it shall be submitted to binding arbitration administered by the Dubai International Arbitration Centre (DIAC) under its Arbitration Rules in force at the time of the dispute. The seat of arbitration shall be Dubai, UAE. The language of arbitration shall be English. The arbitral award shall be final, binding, and enforceable.
17.3. Class Action Waiver. The Customer expressly waives any right to participate in a class action, collective action, or consolidated arbitration. Each claim must be brought on an individual basis only.
17.4. Limitation Period. Any claim must be filed within 6 (six) months of the date on which the Customer knew or should have known of the relevant facts, failing which the claim is permanently barred.
ARTICLE 18 ENTIRE AGREEMENT
18.1. These Terms, together with the Privacy Policy and the specific Package description applicable at the time of purchase, constitute the entire agreement between the Customer and Underworld Pass with respect to the subject matter hereof. They supersede all prior representations, discussions, correspondence, negotiations, undertakings, and agreements, whether oral or written, relating to the same subject matter.
18.2. The Customer confirms that they have not relied on any representation, warranty, or promise not expressly contained in these Terms in deciding to purchase a Package.
ARTICLE 19 SEVERABILITY
19.1. If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be deemed severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
ARTICLE 20 AMENDMENTS TO TERMS
20.1. Underworld Pass reserves the right to amend, update, or revise these Terms at any time.
20.2. Any updated version shall become effective upon publication on the Website, unless otherwise stated.
20.3. Your continued use of the Website or continued purchase of Packages after publication of the updated Terms constitutes your acceptance of those changes.
